Cumberland Farms loses lawsuit towards Massachusetts well being board over flavored cigars

Date:

Cumby’s has misplaced its lawsuit towards an area well being board after an space retailer was busted for providing an unlawful flavored tobacco product on the market.

The Massachusetts Supreme Judicial Court docket has dominated in favor of the Braintree Board of Health, which has been dealing with this flavored tobacco go well with from Cumberland Farms.

The case stems from when a Braintree tobacco and compliance inspection officer carried out a routine test on the Cumby’s on Washington Avenue in April of 2023.

The inspection officer reportedly noticed an open show field of Black & Gentle cigars on a shelf behind the money register. In Massachusetts, these flavored cigars have been banned, so it’s unlawful to promote them.

In consequence, the native board of well being discovered that the shop had violated state and native tobacco legal guidelines and laws by providing a flavored tobacco product on the market, and fined Cumby’s $1,000.

Cumberland Farms has been combating this punishment, arguing that the shop didn’t intend to promote the product and its point-of-sale system would have prevented the product from being rung up and offered.

Additionally, Cumby’s claimed that the native board acted exterior its authority in imposing the $1,000 effective, and “its proceedings were procedurally defective.”

However the SJC justices dominated towards Cumby’s, and affirmed a decrease courtroom ruling for Braintree.

“We conclude that the store’s manner of placement and display of the product, which would have led a customer reasonably to conclude that the product was available for purchase, supported the board’s finding that it was being ‘offered for sale,’ ” reads the SJC ruling.

“We further conclude that the legislative and regulatory scheme governing the sale of tobacco products in Massachusetts expressly contemplates enforcement by local boards of health and permits them to administratively impose the mandatory penalties,” the courtroom wrote. “We also conclude that no procedural irregularities fatally marred the board’s actions. We accordingly affirm the judgment of the Superior Court in this action in the nature of certiorari.”

When the Braintree well being board held a public listening to in regards to the Cumby’s violation, the shop’s district supervisor informed the board {that a} mistake had been made on the delivery warehouse — and he acknowledged that the product mustn’t have been delivered to the shop.

The district supervisor claimed that no Black & Gentle cigars had really been offered as a result of the shop’s point-of-sale system would have prevented a retailer clerk from ringing the product by means of the money register.

The city wouldn’t withdraw the punishment, so Cumby’s filed the criticism in Superior Court docket.

“In Cumberland Farms’ view, an item cannot be ‘offered for sale’ if the store does not actually intend to sell it and the item cannot, in fact, be purchased. We are not persuaded,” reads the SJC ruling. “Whether a product has been offered for sale does not turn on whether the customer can, or ultimately does, purchase the product… The board thus made no error of law in finding the store had offered the cigars for sale, regardless of the store’s intent to consummate a sale.”
